Privacy Policy
This Privacy Policy (hereinafter referred to as the Policy) defines the procedure for processing and protection by Bit SOFTWORKS Limited Liability Company (hereinafter referred to as the Contractor) and its specialists (employees) of information about individuals (hereinafter referred to as Users) that can be obtained by the Contractor when using a website with a domain name "EasyShip.by " (more – Website), provision of services under contracts with legal entities and individuals, individual entrepreneurs (hereinafter referred to as the Contract).
1. Terms and definitions
In the Policy, the following terms and definitions are used wherever not otherwise specified:
1.1. The Contractor is a limited liability company "Bit SOFTWORKS" registered by the Lida District Executive Committee on 18.04.2013.
1.2. User – legal entities, individual entrepreneurs, their employees, as well as individuals who have gained access to the services, services and information posted on the Site (who have concluded an Agreement).
For the purposes of this Privacy Policy, Users include, among others, the Contractor's Partners.
In case of acquisition by legal entities and individual entrepreneurs of access to the Services of the Site for their employees, each such employee is considered a User.
1.3. Partner – any natural or legal person who is a party to the Agreement, who places (searches, views) advertising materials, information about performing organizations and master performers on the Website and books the service of the organization or master.
1.4. Website – a website in the Internet zone of the Republic of Belarus with a domain name "EasyShip.by ", owned by the Contractor (hereinafter referred to as the Site).
The Website is the official source of publication of this Privacy Policy, as well as other information related to the Service.
1.5. Service – providing access to services, services and information posted on the Contractor's Website.
The specific list of Services is defined in the Contract with Users or Partners, respectively.
1.6. Contract – any Contracts for the provision of Services (including those posted on the Website) concluded by the Contractor and legal entities, individuals, individual entrepreneurs, containing a link to this Policy.
1.7. Personal information — personal data of Article 1 of the Law of the Republic of Belarus of 10.11.2008 N 455-Z "On information, informatization and information protection") and other information about the User that the User provides about himself independently or in the process of using the functionality of the Site, other services, programs and products of the Contractor, rendering services under the Contract.
1.8. Processing of personal information – any actions performed with personal information, including collection, recording, systematization, accumulation, storage, updating, use, transfer, deletion and other actions.
1.9. Confidentiality of personal information is a mandatory requirement not to allow their dissemination, except in cases established by law.
1.10. Technical/computer terms are used in the Policy in their commonly used meaning, unless otherwise specified by the Policy.
2. General conditions
2.1. The purpose of this Policy is to ensure proper protection of personal information about Users, including their personal data, from unauthorized access and disclosure.
2.2. Relations related to the collection, storage, dissemination and protection of information provided by the User are regulated by this Policy, other official documents of the Contractor and the current legislation of the Republic of Belarus.
2.3. The use of the Site, including the User's accession to the Agreement (acceptance of acceptance), means the user's unconditional consent to the Privacy Policy and the conditions specified in it for processing his personal information, which is published on the Site.
2.4. In case of disagreement with these terms, the User must refrain from joining the Agreement, using the services, other services, programs and products of the Contractor.
2.5. If the User does not agree with the terms of this Policy, the use of the Services,
2.6. This Policy and the relations between the User and the Contractor arising in connection with the application of the Privacy Policy are subject to the law of the Republic of Belarus.
3. Obligations of the parties
3.1. The User is obliged to:
3.1.1. Provide personal information, including personal data necessary for using the Site.
3.1.2. Update, supplement the provided personal information in case of changes in this information.
3.2. The Contractor is obliged to:
3.2.1. Use the information received exclusively for the purposes specified in this Privacy Policy.
3.2.2. To ensure the storage of personal information in secret, not to disclose without the prior written permission of the User, as well as not to sell, exchange, publish, or disclose in other possible ways the transferred personal information (personal data) of the User, except for the cases provided for in this Privacy Policy.
3.2.3. Take precautions to protect the User's personal information in accordance with the procedure usually used to protect this kind of information in the existing business turnover.
3.2.4. To block personal information (personal data) related to the relevant User from the moment of the request or request of the User or his legal representative or the authorized body for the protection of the rights of personal data subjects for the period of verification, in case of identification of false personal information (personal data) or illegal actions.
4. Personal information of users that the contractor receives and processes
4.1. Within the framework of this Policy, "User's personal information" means:
4.1.1. Personal information that the user provides about himself/herself, including the User's personal data provided by:
- when registering on the Website, - when using the Personal Account and the Website, - when filling out the feedback form on the Website, - when corresponding in online chat, messengers and when using other means of communication, - when booking a service purchased on the Website.
The information required for the provision of Services is marked in a special way.
Other information is provided by the user at his discretion.
4.1.2. Data that is automatically transmitted during the use of the Site using the software installed on the User's device, including IP address, information from cookies, information about the user's browser (or other program that accesses the Site), access time, the address of the requested page.
4.1.3. Other information about the User, the collection and/or provision of which is necessary
4.2. Disabling cookies may result in the inability to access parts of the Site that require authorization.
4.3. This Policy applies only to the Website. The Contractor does not control and is not responsible for third-party sites to which the user can click on the links available on the Site. On such sites, other personal information may be collected or requested from the User, as well as other actions may be performed.
4.4. In general, the Contractor does not verify the accuracy of the personal information provided by Users and does not monitor their legal capacity. However, the Contractor assumes that the user provides reliable and sufficient personal information on the issues proposed in the registration form and keeps this information up to date. The consequences of providing false information may be established in the Contract.
5. Purposes of collecting and processing users' personal information
5.1. The Contractor collects and stores only the personal information (personal data) that is necessary for the provision of Services and the use of the Site by the User.
5.2. The Contractor may use the User's Personal information for the following purposes:
5.2.1. identification of the User within the framework of agreements and contracts with the Contractor;
5.2.2. providing the User with access to personalized Website resources;
5.2.3. provision of Services to the User;
5.2.4. payment for the Contractor's Services;
5.2.5. providing the User with access to third-party websites or services of the Contractor's Partners in order to receive their discounts, offers and services;
5.2.6. communication with the User, including sending notifications, requests and information related to the provision of Services and use of the Site, as well as processing requests and requests from the User;
5.2.7. improving the quality of the Site, the convenience of its use, the development of new services;
5.2.8. targeting of advertising materials;
5.2.9. conducting statistical and other research based on depersonalized data.
5.3. The processing of the User's personal data is carried out without time limit, in any legal way, including in personal data information systems using automation tools or without the use of such tools.
5.4. The User's personal data may be transferred to the authorized state authorities of the Republic of Belarus only on the grounds and in accordance with the procedure established by the legislation of the Republic of Belarus.
6. Conditions for processing the user's personal information and its transfer to third parties
6.1. The Contractor stores the personal information of Users in accordance with its internal regulations and the requirements of the legislation of the Republic of Belarus.
6.2. When processing personal data of Users, the Contractor is guided by the current legislation of the Republic of Belarus.
6.3. With respect to the User's personal information, its confidentiality is maintained, except in cases where the User voluntarily provides information about himself for general access to an unlimited number of persons. When using certain services, the User agrees that a certain part of his personal information becomes publicly available.
6.4. The Contractor has the right to transfer the User's personal information to third parties in the following cases:
the User has expressed his consent to such actions;
6.4.1. the transfer is necessary to provide Services to the User;
6.4.2. for processing on the terms and for the purposes defined in this Policy, as well as in the Contract.
6.4.3. the transfer is provided for by the legislation of the Republic of Belarus or other applicable legislation within the framework of the procedure established by law;
6.4.4. the transfer takes place within the framework of the sale or other transfer of the business (in whole or in part), while the acquirer assumes all obligations to comply with the terms of this Policy in relation to the personal information received by him;
6.4.5. in order to ensure the possibility of protecting the rights and legitimate interests of the Contractor or third parties in cases where the User violates the Agreement.
7. Change of personal information by the user
7.1. The User may at any time change (update, supplement) the personal information provided by him or part of it, as well as the parameters of its confidentiality, using the technical capabilities of the Site and/ or contacting the Contractor in another way (messengers, e-mail contact@bitsoftworks.com ).
7.2. The User can also change the information provided by him within a certain account personal information. At the same time, the change of data may result in the inability to use the Site, use the Services.
8. Measures applied to protect users' personal information
8.1. The Contractor takes the necessary and sufficient organizational and technical measures to protect the User's personal information from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, as well as from other illegal actions with it by third parties.
8.2. The Contractor provides access to the User's personal information (personal data) only to those employees, contractors and affiliated persons who need this information to ensure the functioning of the Site and the provision of Services to the User.
8.3. In case of loss or disclosure of personal data, the Contractor informs the User about the loss or disclosure of personal data.
9. Dispute Resolution
9.1. Before applying to the court with a claim for disputes arising from the relationship between the Site User and the Contractor, it is mandatory to submit a claim (a written proposal for a voluntary settlement of the dispute).
9.2. The recipient of the claim within 30 calendar days from the date of receipt of the claim, notifies the applicant of the claim in writing about the results of consideration of the claim.
9.3. If an agreement is not reached, the dispute will be referred to the judicial authority in accordance with the current legislation of the Republic of Belarus at the location of the Contractor.
10. Modification of the Privacy Policy
10.1. The Contractor has the right to make changes to this Privacy Policy without prior agreement with the User by posting its current version on the Website.
10.2. When making changes in the current version, the date of the last update is indicated.
10.3. The new version of the Policy comes into force from the moment it is posted on the Website, unless otherwise provided by the new version of the Policy.
10.4. The User undertakes to regularly independently monitor changes to the Privacy Policy by reviewing its current version.
